Commission Claw Backs

Commission claw back clauses on listings are perfectly acceptable, provided the commission in the Co-operating Brokerage Commission section of the Property Information Form is the same as the commission on the Listing Agreement, and both documents are signed and dated by the Seller.

Commission claw back clauses cannot be added to the Commission to Co-operating Brokerage section of the Property Information Form, or to an additional schedule, if they are different than what is on the signed Listing Agreement. By ensuring that the commission to the Co-operating Brokerage is the same on the Listing Agreement,  and Property Information Form, or any Schedule to the Listing Agreement, you will be complying with Sections 38 and 39 of the RECO Code of Ethics.

If you are changing commission to the Co-operating Brokerage Commission, after the Seller has signed the original Listing Agreement and Property Information Form, you must ensure you complete either the Amendment to the Listing Agreement Form or OREA’s Form #244 “Seller’s Direction re: Property/Offers”, detailing the changes to the commission, both of which are to be signed and dated by the Seller.

Cumulative Days on Market (CDOM)

Effective Tuesday, December 10, 2019, a new business rule was implemented in the RAHB Matrix system for Cumulative Days on Market (CDOM).

When a listing is “cancelled” or “expires” and is relisted with the same Brokerage within a period of 60 days from the date of cancellation or expiry, the cumulative days on market (CDOM) will continue counting the total days on market.

When a listing is “cancelled” or “expires” and is relisted after a period of 60 days with the same Brokerage, the CDOM counter will reset and begin counting at zero.

If a listing is “cancelled” or “expires” and is relisted with a different Brokerage, the CDOM rule will not apply.

This change will ensure the actual Days on Market is reflected in the listing history.

The CDOM will appear on the REALTOR® Full report for all property types.

CEO Announcement

Dear fellow RAHB members,

On behalf of your Board of Directors, I am pleased and proud to announce that we have hired a new Chief Executive Officer (CEO).

Carol Ann Burrell will join the RAHB team as CEO on Monday, October 7. Carol Ann comes with many years of experience in association management. She has earned an Honours B.A. in English and History from the University of Toronto – University of Trinity College, a Public Relations Certificate from Humber College, and is a Certified Association Executive through the Canadian Society of Association Executives.

Below is a list of her experience:

  • Real Estate Institute of Canada (REIC) – Executive Director & CEO – January to February 2018
  • REIC – Associate Director (part-time contract through Outcome Group) – January to December 2017
  • Ontario Association of Osteopathic Manual Practitioners – Project Manager (part-time contract through Outcome Group) – January to November 2017
  • Canadian Institute of Food Science and Technology – Executive Director (full-time contract through Outcome Group) – February 2004 to December 2017
  • Canadian Association of Exposition Management – Executive Director – September 1991 to January 2004

Carol Ann also served for 13 years in the Royal Canadian Naval Reserve, is a 3rd degree black belt in Goju-Ryu karate and holds the title of senpai.

We look forward to working with Carol Ann and learning from her leadership experience.

A reminder about notifying RAHB of terminations in your office
Brokerages are responsible for notifying RAHB when members in their office resign or otherwise leave.  Notice must be received by RAHB within seven business days of the member leaving.  If notice is delayed beyond the seven business days, the Brokerage will be assessed a penalty of $50 per incident. (RAHB Bylaw, Article 4, Section 1.02.)

I hope you are all enjoying a wonderful summer. It’s been a few weeks since my last update, so I thought I would highlight a few things happening at RAHB and within the real estate profession.

RECO & REBBA, 2002

You may have recently read about a broker in Cambridge who conducted their business unethically, and the resulting repercussions from the Real Estate Council of Ontario (RECO). Since it is important for our clients and the general public to understand that we do not tolerate such behaviour, I wrote a letter to the editor of the Hamilton Spectator stating that we believe individuals who are found guilty of severe ethical violations and illegal business activity have no place in the real estate profession. I also reiterated the significance of three recommendations made by OREA to modernize the 17-year-old legislation that governs REBBA (the Real Estate and Business Brokers Act of 2002). CEO SELECTION

Our CEO Selection Committee is working on schedule, with the final candidate evaluation and assessment expected to be completed by the end of August.

I would like to again thank the interim CEOs – Kim and Carolyn – for providing great leadership during this time of transition. On behalf of the Board of Directors, I would also like to extend our thanks to our very dedicated RAHB staff, who have been working diligently to ensure there is no gap in service to RAHB members.

DATA SHARING

Your Board of Directors is spending a considerable amount of time investigating options that will enable RAHB to provide more MLS® data to our members. This work requires careful consideration, thorough research, and confidential discussions with other real estate organizations.

I would like to emphasize again that our Board is committed to not only maintaining existing data-sharing relationships but also to evaluating and further enhancing data-sharing opportunities. It is vital to all of us at RAHB and it remains our current primary focus.

On a related matter, we’ve heard comments and questions on why all REALTORS® are not required to inter-board onto the MLS® of the board or association where their listing is geographically located. I agree that this would be beneficial; however, RAHB cannot:

  • force non-members to list/inter-board on our MLS®,
  • force non-members to abide by our rules, regulations or policy, or
  • dictate to REALTORS® how or how not to conduct their business.

Unfortunately, this is the reality of the situation and not something RAHB can act on unilaterally. As a result, we are looking at other options to achieve the same objective of comprehensive gap-free data.

Thank you again for your feedback through the TREB Data Survey, as well as informally at RAHB events. Your input is valuable and we appreciate your willingness to get involved by expressing your comments and ideas.

Rental Scam – Caledonia

A RAHB member has informed both the OPP and RAHB of a situation unfolding in Caledonia regarding their listing. A house in Caledonia, which was an estate sale, was sold firm and expected to close in two weeks’ time. The house itself was vacant and empty. Someone has taken the listing information and photos of the house and posted the information online as a rental. The rental ad contains very specific information, such as the current owners of the house do not want people to contact the REALTOR® and to avoid knocking on the door as the owners are out of town. The rental also asks for first and last month’s rent.

The OPP is currently investigating the situation. We will provide any relevant updates when available. Please be aware of similar situations and please report suspected rental scams to police immediately.

Golf Tournament Recap

Our Golf Tournament – Network, 9 & Dine took place on Thursday, May 23 at the beautiful Heron Point Golf Links. We were happy that the weather was on our side and over 100 golfers were able to enjoy nine holes of golf! All golfers were then treated to a delicious BBQ dinner put on by the wonderful staff at Heron Point.

Thank you to all of the golfers who attended the event and made it such a success! We also could not have put on this event without our generous sponsors!
