Say goodbye Realinfo and hello NewsReal!

We are pleased to let you know that all RAHB news will be coming to you in our new weekly email, NewsReal!

You will receive NewsReal by email each Wednesday, and it will include features, updates and the information you would usually find in Realinfo.

Realinfo has served well as our main vehicle for providing information and RAHB news through the years. Over time, however, our communications to you have become more frequent with information that is more time-sensitive, so instead of bombarding you with ever-more emails in addition to Realinfo, we will send a weekly update of what’s new and noteworthy.

NewsReal has already begun, and we hope you find the format easy to read and the contents informative.
Realinfo features such as Realty Shoppe specials, new members, professional development offerings, ethics issues, and so on will continue in NewsReal, so be sure to watch for them.

Joint Data Share Announcement From RAHB and ORTIS

The email was sent to all members on Friday, August 4, 2017

ORTIS and RAHB are pleased to announce that we have reached an agreement regarding data sharing. The data share that you all enjoy now, as either users of ORTIS or members of RAHB, will continue, uninterrupted when RAHB moves from its current Fusion platform to Matrix. We’ll be in touch with further details in the near future. If you have any questions in the meantime, please contact RAHB’s MLS® department at 905.667-4650 or mls@rahb.ca.

To allow time for CoreLogic to put in place the data share program, RAHB will extend the cut over date to its new Matrix system from August 15th to the beginning of October. Until then RAHB and ORTIS users will experience no change in the existing data share and data access.

Update on data Sharing contract with ORTIS

The following letter was sent to all members of July 19, 2017.

Dear Member:

 

Yesterday [July 18, 2017] afternoon, RAHB’s Board of Directors met to review in detail the latest draft of the data share contract provided by ORTIS.

 

Although there are ten areas we still have concerns with, in the spirit of cooperation to get the contract in place, we are ready to accept eight as-is, leaving only two outstanding items we cannot accept. These last two items were already previously agreed to by both RAHB and ORTIS but were deleted by ORTIS in their latest draft.

 

The two items deal with control of the distribution of data and reciprocity of data access. Data is a critical asset for brokerages and members, and proper distribution and control are vital to ensuring the continued success of our REALTORS®. It is unfortunate these last two items were removed, as RAHB was prepared to sign the contract yesterday.

 

Therefore, this week RAHB’s lawyer will write the two deleted items back into the contract, and will seek agreement from ORTIS, which would result in a signed contract. RAHB will also ask ORTIS to not shut off the current data feed, as we understand they plan to do on August 15, 2017, so that CoreLogic would have the 6-8 weeks they need to complete the new data transfer program between RAHB’s Matrix system and the regional system. In this event, RAHB will re-schedule our Matrix go-live date so you will continue to have uninterrupted access to all RAHB and regional listings.

 

Should ORTIS not agree to reinstate the two outstanding items, and in order to provide you as much notice as possible, RAHB will schedule a Members Meeting to be held in August. At that time you can address any questions directly to us and to your Board of Directors since we fully appreciate there has been much uncertainty about the data share. However, until the completion of negotiations, or preferably until the contract is signed, your Board of Directors is not in a position to speak in as much detail as you perhaps would prefer.  We do not think it is appropriate to negotiate business contracts in public or to share drafts on social media sites.

 

An update will be provided again next week as to the status of the data share contract at that time.

Smithville Area 57 boundaries extended

The RAHB Board of Directors approved a change to the Smithville (SM 57) boundary to line up with the official urban boundaries for Smithville Township.

The previous Smithville boundary was set many years ago, prior to the recent residential development in the township. Some new developments are legally within Smithville Township but lay outside the long-standing RAHB boundaries and therefore had to be listed in GR55. Anyone searching for properties in Smithville might well have missed those listed in GR 55.

RAHB’s MLS® Committee consulted with members who are active in the area and with the Township of West Lincoln, and recommended that RAHB’s boundary should follow that of the Township.  Now, members with listings in Smithville and those searching for listings in Smithville will be able to use the SM 57 area code and be confident the properties are located in the correct area.

The change in boundary is now in effect. All active and historical listings have been updated in Fusion and Matrix. RAHB’s Outlying Areas map will be updated at the next printing, and CoreLogic will update the boundary for the overlay on the map search prior to RAHB’s full cut over to Matrix.

A reminder about notifying RAHB of terminations in your office

Brokerages are responsible for notifying RAHB when members in their office resign or otherwise leave. Notice must be received by RAHB within seven business days of the member leaving. If notice is delayed beyond the seven business days, the Brokerage will be assessed a penalty of $50 per incident. (RAHB Bylaw, Article 4, Section 1.02.)

Important change to preemptive (“bully”) offer process

To help clarify the steps you must take if your Sellers change their minds about “no offers until”, the Board of Directors approved several changes to Section 2 of the MLS® Rules and Regulations.

The chart below shows the original wording of Section 2, Subsection 2.15 of the MLS® Rules and Regulations in the left column, and the new wording in the right.

Note the changes to the first parts (2.15 and 2.15 (a)) have been amended by the addition of the words in bold, and section 2.15 (b), shown in all bold text, has been re-worded from the original to provide more clarity.

The complete rewriting of Section 2.15 (b) is based on the Registrar’s Bulletin from February 21, 2017, titled Written direction for multiple offers.  The Bulletin provided an excellent overview of how to convey offers to your clients in a preemptive offer situation and stressed the importance of using a fair and transparent process.

These changes are now in effect.
