MLS® Updates

Two New MLS® Policies

A joint RAHB/NAR MLS® committee reviewed the Access Agreement which existed prior to the shared MLS® database.  The Access Agreement was no longer necessary with the shared database, but there was a provision in the Agreement which was not covered by either association’s MLS® Rules and Regulations or Policies, namely which association’s rules and regulations or policies were to be followed when a member takes a listing in the other association’s market area.

To address the situation, the following policy has been adopted by both RAHB and NAR and is now in effect:

1. When a member from either RAHB or the Niagara Association places a listing located in the other association’s jurisdictional boundary, the member must adhere to that association’s MLS® Rules & Regulations and MLS® policies including, but not limited to, completion of all mandatory areas on the property information form (PIF), the reporting of conditional and firm sales, etc.

A new situation also arose with the shared database that needed to be addressed:  whether members who have been suspended from one Association’s MLS® system through Scout remediation would be able to access the MLS® system through the other association.

The following policy was also adopted by both associations and is now in effect:

2.  If a RAHB or Niagara member/user is disabled through remediation, the said member/user will not be permitted to join either Association for the purpose of obtaining access to the MLS® system.

 

MLS® Fines – Increases and New Fines

The RAHB Board of Directors recently approved the following amended fines to take effect November 1, 2012.  The fines are assessed to either the Brokerage or Member.

11.  Multiple Contracts and PIF’s Single Property:  When a Pending Sale is being reported on a listing, all additional listings must be cancelled by way of a Cancellation of Listing Agreement signed by the Seller and Broker.  The cancellation must be received by RAHB the same day as the report of sale or a $100 fine will be levied to the member for each listing.

3.  A fine of $100 for all members, in addition to the standard $50 no photo fee, if the member does not submit a photo for listings outside of our photographers’ area after the initial fine has been levied.

The following MLS® policies have been amended to include a fine:

Miscellaneous
12.  If any audited listing is found to be in contravention of the basic MLS® standards such that if said Listing would have initially been submitted to RAHB for processing, and RAHB would not have processed it, will be immediately removed from the active and historical MLS® database.  ($200 fine added)


Taxes
1.  If taxes have not been set for the current year, the listing may only display the previous year’s taxes.  Thirty (30) days after the tax rate has been set, taxes on all new MLS® listings must be for the current year.  ($100 fine added)

 

Reminder:  “Pending Sale” status changed to “Sold” status
With the introduction of Fusion and the joint MLS® database for RAHB and Niagara, and in an effort to offer consistent reporting methods for both association, “pending sale” status was removed effective August 1, 2012.  All sales are now to be reported as “SO”.

RAHB’s 11th HOAP project completed!

Another family has realized the dream of home ownership thanks to the Home Ownership Affordability Partnership (HOAP).  The keys to the property were handed over at a ceremony on August 29.

“This is our eleventh HOAP home,” said HOAP Chair Tim Mattioli, “and the pride and satisfaction we get from helping deserving families move into their own homes never gets stale.”

HOAP received generous assistance from community members on this project:  Stephen Frankel of Frankel Law Offices donated legal services; Ann Forbes Arndt of Homelife Macro Realty Inc. donated real estate services, and Ernie Mallozzo of Lighthouse Inspections Hamilton donated home inspection services.

A twelfth HOAP project is planned for the fall of this year.

Staff Profiles – Meet Ross

Ross Godsoe

Ross is RAHB’s Chief Executive Officer, responsible for managing all operations of the association.  He works closely with the president and board of directors and with the staff who assist him provide member services to RAHB members.

Ross is especially well-suited to the role of CEO of a real estate association.  When he joined RAHB in 2001, he brought with him a wealth of experience from all facets of the real estate industry.

Ross owned a real estate brokerage in Mississauga for 26 years.  He was involved in residential and commercial real estate, real estate development and property management.  As a member of the Mississauga Real Estate Board, Ross started volunteering in the association and found himself serving as president in 1987.  From the Mississauga Board, Ross became involved on the OREA Board (he served as president in 1994) and on the CREA Board, where he served as president in 2000.  In total, Ross spent 18 consecutive years as a volunteer in three levels of organized real estate.

Just at the time Ross was considering other business opportunities, he became aware of the opening for a CEO at RAHB.  As a business person who understood both the business side and member side of real estate, he believed he would be a good fit for the position and the selection committee obviously thought so, too.

Member service is Ross’s primary focus in his role as CEO and he is excited to have assembled a team of staff with the same focus.  In looking at the highlights of his time at RAHB, Ross cites the move from the legacy MLS® system to MLXchange as a one of the great member services he has overseen.  Other highlights include the relationships established in organized real estate coast to coast and beyond, relationships fostered with other organizations which are leaders in the Greater Hamilton-Burlington communities and – Ross’s special passion – the Home Ownership Affordability Partnership (HOAP) with the City of Hamilton and ScotiaBank.

Ross is the recipient of the prestigious W. Frank Johns Award in recognition of his “dedicated leadership, contributions and support … in developing the professional role and status of executive officers.”

RAHB has recently experienced a number of visits to the Realty Shoppe by the general public, who advise us that they have been directed to RAHB by their REALTOR®.

Members are reminded that the Association is a not-for-profit organization that provides services only to its dues-paying members, and cannot sell goods to the general public.

 

Kudos to Cupido

Congratulations to RAHB member Mario Cupido, one of 29 recipients of the Queen Elizabeth II Diamond Jubilee Medal.

The medal was created to mark the diamond anniversary of Queen Elizabeth II’s accession to the throne and is presented to Canadians who have made significant contributions to their communities.

Mario recently received his medal in a ceremony presided over by Senator David Braley.

CREA Updates

Futures Implementation Team Recommendation:
Nix FSBOs on REALTOR.ca

CREA’s Futures Implementation Team (FIT) met in July to discuss the 23 recommendations in the Organized Real Estate (ORE) Collaborative Strategy Map to the Future.

One of the most controversial issues under discussion was the recommendation to look at ways to include FSBO and non-MLS® listings on REALTOR.ca.  After presentations on legal and other issues, FIT recommended that no further action be taken.  The FIT recommendation will go to the CREA Fall Assembly Meeting.

The other significant outcome of the FIT meetings was a recommendation for a business plan to have an outside organization run REALTOR.ca.

CREA is just finishing up the last touches on the third party destinations but the rest of the DDF is accessible to brokerages which have opted in to the program and their salespeople.
