The association continues to receive complaints from members of the public that they are being contacted by real estate sales representatives after their listing has expired.

Members are reminded that calling on expired listings is a violation under PIPEDA, the Do Not Call legislation as well as RAHB’s Rules and Regulations.

Section 6, Solicitation, Sub-section 6.05 states:

Notwithstanding the foregoing provisions, under no circumstances shall the following sources be used by a Member to identify prospective clients:

i)     The MLS® database;
ii)    Members’ real estate signs;
iii)   Other member-generated sources of information such as, but limited to, printed and television advertising, office window displays, internet.

The bottom line is that you may not call on any expired listings unless you have a previous professional relationship with the client.
