The situation from last month :

Sophie Salesperson was the target of verbal abuse and disparaging comments at her public open house.  The abuser was Mary, a new salesperson from another Brokerage.  Was there anything Sophie could do about Mary?

There are actually a number of ways Sophie could proceed.  First, she can try to work things out with Mary and come to some agreement about how they can deal with each other in the future.  If that doesn’t work, she should speak with her Broker and see if there’s something her Broker could do with Mary’s Broker to resolve the issue.

Sophie could also lodge a complaint about Mary with RECO, citing her behaviour as a possible breach of the REBBA 2002 Code of Ethics:

Fairness, honesty, etc.

A registrant shall treat every person the registrant deals with in the course of a trade in real estate fairly, honestly and with integrity.

There is a corresponding Article in CREA’s REALTOR® Code – Article 19:  Discrediting another Registrant – which is more descriptive about a REALTOR®’s obligation to treat other real estate professionals with courtesy:

Article 19:  Discrediting another Registrant
The REALTOR® shall never publicly discredit any other Registrant.  If the REALTOR®’s opinion is sought, it should be rendered with strict professional integrity and courtesy.

19.1
The REALTOR® should not comment in a derogatory manner as to the capacity, integrity, and competence of any other Registrant.

Where any REALTOR® is asked to comment on a specific transaction or the business practices of another Registrant, such comments should be given with strict professional integrity, objectivity and courtesy.

Just because RECO would handle Sophie’s complaint doesn’t mean that Mary doesn’t have to abide by CREA’s REALTOR® Code as well.

Mary is a new salesperson and has a lot to learn about how to work with other REALTORS®.
